GA: Charges Dismissed Against Randall Thaxton

    Charges dismissed in dog fighting case

    Charges against a Union Hill man accused of raising pit bulls for dog fighting have been dismissed.

    Randall Thaxton, 46, was arrested in October 2008 by the Cherokee Sheriff's Office after a two-week joint investigation in Cherokee and Gilmer counties.

    He was arrested on seven counts of felony dog fighting, 10 counts of animal cruelty and one count of possession of marijuana.

    Investigators at the time of his arrest said dogs found at Thaxton's home had scars and other injuries that appeared to be the result of dog fighting.

    Ten dogs were seized as was a treadmill designed for dogs and breeding equipment.

    Thaxton's family denied his involvement in dog fighting, contending the pit bulls were raised for dog shows.

    In January, Thaxton was indicted by the Cherokee County grand jury on only the animal cruelty and drug charges.

    According to the indictment, Thaxton caused "unjustifiable physical pain" to American pit bull terriers. The juvenile dogs were found on collars and chains weighing between 4.6 and 8.8 pounds.

    District Attorney Garry Moss at the time of the indictment said he would not pursue the dog fighting charges.

    According to court records, a motion to suppress evidence gathered by investigators from Thaxton's home was granted on Thursday.

    Thaxton's attorney in the motion argued the search warrant was illegal as it wasn't supported by probable cause.

    Cherokee County Superior Court Judge Frank C. Mills III then dismissed the charges, according to the district attorney's office.

    Assistant District Attorney Patricia Hull declined to comment on the case.

    Mills and attorneys for Thaxton didn't return calls for comment by press time.

    Following his arrest and the seizure and euthanization of his dogs, Thaxton filed a lawsuit against the county government, which is pending.

    Yeah you can tell I'm half asleep and not reading right. :lol:

    He damn sure better win his lawsuit then. Best of luck to the guy, although nothing will ever replace his dogs.

    This makes me sick. There was a stand at the dog-a-thon yesterday with a few of those H$U$ 'finding a dog fighter will get you $5000' posters. I wanted to vomit. And they were 'pit bull' advocates!!

    That's one F-ed up definition of "rescue"

    From the comment section of that article that pretty much sums up
    what the real motivation is behind the witch hunts (along with the $$$ motive of: seize + pose with "rescued" dogs = donations)

    if this breed of dog were banned/eradicated, then the blood sport of dog fighting would go away. No fighting dogs, no fights.

    No matter what your views are on dog fighting, if you own and/or love
    this breed, it's time to wake up. We are at war.

    I wonder what the number of killed dogs to acquittal ratio is?

    That is why ppl shouldn't support dogfighting laws. Infact dogfighting shouldn't even be illegal.

    :( I've been to several AKC AmStaff breeders' homes/kennels, and I have seen items that would be considered "dog fighting training paraphenalia" by some people that don't know better (if someone wanted to state such....treadmills, etc.) Sad really.

    I already have no doubt that you would sacrafice another persons animals. No one else should doubt it either...Clearly ^ LOL!

    No one said that anyone had to be ok with dogfighting. infact I wouldn't want anyone to fight your currs or talk you in to it. These laws do not justify the means to the ends. The injustice at the end of these laws should have anyone with any sense OUTRAGED!

    Insult away kiddo. AND BTW, no one could ever talk me into fighting my dog. Yes, it does upset me to see these dogs getting put down when it wasn't their choice to be in that situation.
    With that said, I don't mind seeing the owners going to jail though.

    Another shining example of people claiming to be "protecting" animals, when the real agenda is to eradicate the breed. So many people arrested, only to have the charges dropped or found not guilty because there was no evidence, but the damage is done anyway. I'm afraid to find out how many good dogs from the old lines have been taken out of the gene pool, either by neutering or euthanasia, because someone was "saving" them.

    his dogs were put down by a local vet about a few months before he got his charges droped Randall has been dilling with this stuff for over 2 years my heart goes out to him and sheila
